Personal Injury Compensation*

All personal injury claims in Ireland (except for cases involving medical negligence) must first be submitted to the Personal Injuries Assessment Board or as they are now known, InjuriesBoard.ie.  They provide an independent assessment of personal injury claims for compensation following road traffic, workplace or public liability accidents.

The form is reasonably straightforward but if you have any doubts, ask a Solicitor to help you as problems can occur at this stage that can be time consuming and costly to resolve later on.  For example, it is really important to get the correct name of the respondent i.e. the party against whom a claim is being made, especially if it is a company and you can very easily end up taking an action against the wrong company.

If either side rejects the assessment made by InjuriesBoard.ie, it will issue an authorisation to allow you, the claimant, to take the matter to Court in the normal way.  If both sides agree to the assessment, the respondent must pay the agreed amount and that’s the end of the matter.

Of course there are many other types of situations where you may be entitled to compensation, such as product liability, nuisance claims or defamation, that do not involve Injuries Board.ie.  Contacting your Solicitor can be a great way to find out your rights and entitlements.
