Wills & Probate
Making a Will is one of the most important things we can ever do. It determines how our most personal possessions and hard-earned savings are shared among close family and friends. It is often simple and cheap to do but is easily overlooked.
At Brendan Burke Solicitors, we are happy to advise you on the administration of the estate – from reading the Will to distributing the assets, to managing taxes.
If you die without making a Will or if you make an invalid Will, you will die intestate, and it will be the law, not you, that will decide who will get your assets. Failure to make a Will can pose big problems for those left behind, not least because the beneficiaries may end up paying more inheritance tax than is necessary.
Once you make a Will, your estate – your money, possessions and other assets, can be distributed exactly as you decide among your spouse, partner, children, close family and friends. You can also include charitable bequests in your Will.
Your Will is also an important tax-planning device. By drafting it so as to make the best possible use of the available tax reliefs, you can reduce or even eliminate any inheritance tax liability for the beneficiaries. The potential inheritance tax liability is determined by the beneficiary’s relationship to the deceased.
We would strongly urge every adult to make a Will under the guidance of an experienced Solicitor. A Will should be simple but it can be complicated. It won’t be expensive and it will help minimise family disagreements and reduce legal costs.
